This single document is our Terms of Use, our Privacy Policy, and our notice under Section 5 of the Digital Personal Data Protection Act, 2023.

By messaging our WhatsApp number or using itsokay.co.in, you accept these terms. If you don't accept them, don't use the service.

1. Emergencies

It's Okay is not an emergency service. It is fully automated. No human monitors it. It cannot summon help for you.

2. What this is

A free, non-commercial, experimental AI tool offering general breathing and grounding content during anxiety or panic. Run by an individual, not a company. No revenue, no ads, nothing for sale.

It is not: medical advice, diagnosis or treatment; therapy, counselling or psychiatric care; a crisis line; a medical device; or any professional relationship. It is not delivered, supervised or endorsed by any clinician. The operator holds no registration under the Mental Healthcare Act, 2017.

It is a beta. It will contain errors, may respond wrongly or unhelpfully, may fail to recognise that you are in danger, may be unavailable when you need it, and may be discontinued at any time without notice. Do not build a safety plan around it.

3. AI and synthetic voice

Replies are AI-generated. Any voice you hear is synthetic — not a recording of a real person, and not a sign that anyone is listening. The AI does not know you, your history or your medication. Everything it says is general information, never personalised advice. Never delay professional help because of anything it says.

4. Safety of the exercises

Do not use the breathing exercises if you have asthma, COPD or other respiratory conditions, heart disease, epilepsy, low blood pressure, glaucoma, are pregnant, or are under the influence of alcohol or drugs, without asking a doctor first. Stop immediately if you feel faint, dizzy or any chest pain. Never use while driving, cycling, operating machinery or in water. Cold-water techniques are unsuitable if you have any cardiac condition or Raynaud's. All exercises are at your own risk.

Not for clinical conditions. This service is not designed or validated for, and must form no part of managing, suicidal ideation, self-harm, psychosis, bipolar disorder, PTSD, eating disorders, substance withdrawal or any diagnosed psychiatric condition. If any apply to you, seek professional care.

5. India only

Offered solely to people in India and governed solely by Indian law. We do not market to, target or knowingly serve users in the EU, EEA, UK, Switzerland, USA, Brazil or elsewhere, and do not monitor behaviour there.

No rights are offered under the GDPR, UK GDPR, CCPA/CPRA, LGPD, HIPAA, PIPEDA or any other non-Indian law, and no compliance with them is claimed. Use from outside India is unsolicited, at your own risk, in breach of these terms, and governed by Indian law alone.

6. Your data

What we process

Your WhatsApp number, the messages you send, and the language you write in — used only to generate a reply to you, in the moment.

What we keep

Nothing. No transcripts, no audio, no metadata, no history, no profile, no record of you. Our agent is configured with retention set to zero and automatic deletion of transcripts, personal information and audio. Audio is never stored.

There is no archive. Nothing is read by a human. There is nothing for us to sell, leak, lose or hand over.

What we never ask for

Your name, address, email, college, ID numbers, Aadhaar, PAN, payment details or photographs. Please don't send them. If you do, they are handled the same way — processed briefly, kept never.

Who else is involved

  • WhatsApp, operated by Meta — carries your messages. Governed by Meta's own privacy policy, which we don't control and can't override. WhatsApp Business Platform messages are not end-to-end encrypted the way ordinary WhatsApp chats are.
  • A third-party conversational AI platform and an AI language model provider — run the agent and generate replies. Configured as above.

Provider identities will be disclosed on written request to the Grievance Officer, and to the Data Protection Board of India on request. Some processing occurs outside India, as permitted by the DPDP Act.

No selling, no ads, no profiling

We don't sell, rent, trade or share your data with advertisers, brokers, insurers, employers or colleges. No profiles, no behavioural tracking, no training models on your conversations.

Consent and your rights

You consent by messaging us after seeing our notice. Withdraw any time by replying STOP, or email alec@itsokay.co.in. Withdrawal is immediate and doesn't affect earlier processing. It does not remove anything held by Meta — use WhatsApp's own controls for that.

Under the DPDP Act you may request access, correction, completion, updating or erasure; nominate someone to exercise your rights on your death or incapacity; and raise a grievance. Email alec@itsokay.co.in — acknowledged within 72 hours, resolved within 30 days. Since we retain nothing, our answer to most access requests will be that we hold no personal data about you.

If unresolved, you may complain to the Data Protection Board of India. Under DPDP s.15 you must not impersonate anyone, suppress material information or file false grievances.

If you are under 18

The breathing and grounding content is available to you, and we keep nothing about you — the same as for everyone. But please also tell a parent, teacher or another adult you trust that you're struggling, and call Childline 1098 or Tele-MANAS 14416. This is a breathing exercise, not a grown-up who can help you. Please find one.

Security

Encryption in transit, no personal data stored under our control, shortest retention our platform allows. No system is perfectly secure, and this is an experimental beta run by one person, not an audited enterprise platform. You transmit at your own risk. Any breach will be notified as the DPDP Act requires.

7. Your obligations

Don't use this service from outside India; don't rely on it in an emergency; don't submit anyone else's personal data; don't misuse, scrape, overload, reverse-engineer or jailbreak it; don't use it unlawfully; and don't represent it as endorsed by any clinician or institution.

8. Warranties, risk and liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", FREE OF CHARGE, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, ACCURACY, RELIABILITY, SAFETY, THERAPEUTIC BENEFIT OR NON-INFRINGEMENT. THERE IS NO WARRANTY THAT IT WILL BE AVAILABLE, ERROR-FREE, SECURE, EFFECTIVE, OR THAT IT WILL DETECT, PREVENT OR RESOLVE ANY PANIC ATTACK, ANXIETY EPISODE OR MENTAL HEALTH CRISIS.

YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK OF USING THIS EXPERIMENTAL SERVICE — including that its output may be wrong or harmful, that it may fail to recognise an emergency, that any exercise may cause physical or psychological harm, that it may be unavailable when needed, and that relying on it may cause you to delay professional or emergency care. You acknowledge you have been clearly and repeatedly told to contact emergency services and qualified professionals, and that any decision not to is your own.

TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW:

  1. (a) The operator is not liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or any loss of profit, data, goodwill or reputation.
  2. (b) The operator is not liable for any death, personal injury, self-harm, suicide, psychological harm, emotional distress, worsening of any condition, delayed or foregone treatment, or any harm to you or any third party arising from use of, or inability to use, the service — including where it failed to detect or respond appropriately to a crisis.
  3. (c) The operator is not liable for the acts, omissions, outages, security failures or data practices of Meta/WhatsApp, any telecom operator, or any AI or hosting provider.
  4. (d) The service is free, experimental and non-commercial. Total aggregate liability for all claims, in contract, tort (including negligence), statute or otherwise, shall not exceed INR 1,000.
  5. (e) These limits apply even if the operator was advised of the possibility of such damages and even if any remedy fails of its essential purpose. Nothing here excludes liability that cannot lawfully be excluded, including for fraud or wilful misconduct.

Indemnity. You agree to indemnify and hold harmless the operator and their heirs, successors and agents against all claims, proceedings, losses, damages, liabilities, penalties, costs and expenses (including reasonable legal fees) arising from your use or misuse of the service, your breach of these terms or any law, your misrepresentation of location, any third-party data you submit, or any claim brought by any third party — including a family member, guardian, institution or insurer — in connection with your use of the service.

9. Availability and changes

Provided with no guarantee of uptime, accuracy or continuity. May be modified, suspended or discontinued at any time, without notice or liability. We may amend these terms by posting a revised version at itsokay.co.in/terms; continued use is acceptance. Access may be terminated at any time for any reason.

10. Disputes

Governed by the laws of India. Any dispute shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, seated at [CITY], India, in English, each party bearing its own costs. All disputes are resolved individually; you waive any right to bring or join a class, collective or representative proceeding. Subject to arbitration, courts at [CITY], India have exclusive jurisdiction. Any claim must be brought within one year of the event giving rise to it.

If any provision is held invalid it shall be modified to the minimum extent necessary or severed, with the rest continuing in force; sections 1–6 and 8 are intended to be enforced to the maximum extent permitted. Failure to enforce is not waiver. This document is the entire agreement. Sections 2, 3, 5, 6, 8 and 10 survive termination. In any conflict between the English version and a translation, English prevails.

By using It's Okay you confirm you have read and accepted this document; that you are in India; that this is a free experimental beta and not a medical or emergency service; that any voice you hear is synthetic; and that no human is monitoring it.
